Plagiarism has become a significant situation that can not be ignored at the recent time. In that case, act in conjunction with such plagiarism is a violation against law and academic ethics. The violation occurs in the form of use of ideas, thoughts, writings, data and other informations by not mentioning a pre-existing source, and the content contained in a particular work appears as a result of original work but in fact it is not original and works of others. The prevention and mitigation of plagiarism has been regulated in several laws, and implementing regulations. But apparently, what happens is the action of plagiarism tends even more and more done in research activities and scientific publications. Research on these actions is an urgent and important undertaking by conducting substantial studies related to the arrangement, implementation, and formulation of appropriate prevention policies and prevention of plagiarism within Higher Education (Universities). This research is conducted by using normative juridical research method supported by secondary data. In addition, it is supported also with primary data through interviews, and equipped with Grindle implementation model approach that is in focus on the content of policy and the implementation of the policy environment (context of implementation). This research produces several things as follows. Careful observation of the prevention and prevention policies of plagiarism beginning with the law, up to the regulations below. The observations confirmed that the provisions of these provisions were inconsistent in the using of required terms. If further analysis is carried out using the Grindle approach, prevention and prevention policies of plagiarism have not yet reached the implementation efforts in accordance with the content of the policy and the needs of the higher education environment. Following up some elements above, researcher determining recommendations as folow (1). Policies concerning the prevention and handling of plagiarism should consistently use the same terms in each of the laws as well as the rules below them. (2). Implementation of derivative policies by Universities shall be initiated and reflected in the college statutes that intellectual property values are upheld, and this good intent should be reflected also in the budget. (3). Prevention of plagiarism should begin with education to raise awareness of law, morals and ethics as well as proper law enforcement. / Fenomena plagiarisme sebagai pelanggaran hukum dan etika akademik terjadi dalam bentuk penggunaan ide, gagasan, pemikiran, tulisan, data dan informasi pihak lain dengan tidak menyebutkan sumbernya, dan semua itu dipersepsikan seakan-akan berasal dari dirinya. Upaya pencegahan dan penanggulangan plagiarisme telah diatur dalam beberapa Undang-Undang, dan peraturan pelaksananya. Namun, kecendrungan makin maraknya tindakan plagiarisme dalam kegiatan penelitian dan publikasi ilmiah, menjadi sesuatu hal yang penting untuk diteliti, yaitu dengan mengkaji substansi pengaturannya, implementasinya, dan memformulasikan kebijakan penanggulangan dan pencegahan plagiarisme yang tepat digunakan di lingkungan Perguruan Tinggi. Dalam penelitian ini digunakan metode penelitian yuridis normatif dengan data sekunder dan ditunjang dengan data primer melalui wawancara, serta dilengkapi dengan pendekatan model implementasi Grindle yang menyoroti isi kebijakan (conten of policy) dan lingkungan implementasi kebijakan (context of implementation). Penelitian ini menghasilkan beberapa hal sebagai berikut. Kebijakan pencegahan dan penanggulangan plagiarisme mulai dari undang-undang, sampai dengan peraturan-peraturan di bawahnya tidak konsisten dalam menggunakan istilah-istilah yang dibutuhkan. Apabila dianalisis menggunakan pendekatan Grindle, kebijakan pencegahan dan penanggulangan plagiarisme belum terimplementasi sesuai dengan isi kebijakan dan kebutuhan lingkungan pendidikan tinggi. Rekomendasi peneliti adalah 1. Kebijakan yang menyangkut pencegahan dan penanggulangan plagiarisme harus konsisten menggunakan istilah yang sama pada setiap undang-undang maupun peraturan-peraturan di bawahnya. 2. Implementasi kebijakan turunannya oleh Perguruan Tinggi harus diawali dan tercermin dalam statuta bahwa nilai-nilai kekayaan intelektual dijunjung tinggi, dan niat baik ini harus tercermin pula di dalam anggaran. 3. Pencegahan dan penanggulangan plagiarisme harus dimulai dengan edukasi untuk meningkatkan kesadaran hukum, moral dan etika serta penegakan hukum secara patut.
