The objective of research entitled “Legal Protection Against Foreign Famous Trademarks in Indonesia (Brand Case Study J Casanova Based on Analysis of Decision No. 11/Pdt.Sus Merek/2016/PN.Niaga.Jkt.Pst. dan Putusan Mahkamah Agung Nomor 968 K/Pdt.Sus-HKI/2016)” to understanding stregth of the brand registration certificate within evidentiary framework of the trial in Commercial Court and to understanding the appropriateness of the Supreme Court’s decision of protection foreign brand law regulation in Indonesia. This research used normative legal research that focuses on the inventory of positive law in which the nature of this study is descriptive qualitative that will answer the problem. Data used in this research is secondary data from existing data sources. The writer used data collection technique with study literature and quantitative data analysis. The result of this study indicates that The Justice Council rejected the lawsuit of J Casanova because the plaintiff can't prove his proposition as the owner of the J Casanova brand. Based on the strength of the evidencing files the plaintiff submitted in the hearing. Therefore, the certificate has passed the period of 10 years from the date of registration. Furthermore, all of Casanova’s registered trademark that have canceled in accordance with the provisions of Article 68 juncto Article 6 letter (b) of the Trademark Law.
