Abstract

Necessary for land today is increasing in line with the development of the Indonesian economy and increasing other needs related to the land. Land is not just for shelter, but also as a place to do business and also as collateral to get a bank loan, for business purposes, lease, and sale and purchase. Once the importance land uses for the person or legal entity requires a legal guarantee of the land. As time in the era of globalization, the possibility of further opening of opportunities for foreign investors to invest and open a business or to own property in Indonesia is huge. Considering if Indonesia is a country with a growing economy, so it will make the businessmen attrack with Indonesia and Indonesia as a place to open a variety of businesses. Therefore limited in terms of land ownership in Indonesia, a lot of foreign investors made a nominee agreement to conduct transactions in investments. It required further research on the validity of the agreement in relation nominee ownership of land in Indonesia. In this study, data collection was done by using the approach of Regulations - regulations and analyzes of several references to get a conclusion. Although no Nominee Agreement notwithstanding the provisions of Article 1320 of the Civil Code and Article 1338 of the Civil Code, according to the author of this agreement is considered as one of the forms of smuggling law because the elements of one of the terms of his agreement valid under Article 1320 of the Civil Code which element A kosher because not fulfilled so the Nominee Agreement in relation to land ownership in Indonesia Clear sake of Law, because these elements are not fulfilled. / Seiring berkembangnya zaman dalam memasuki era globalisasi, kemungkinan semakin terbukanya kesempatan investor asing untuk berinvestasi dan membuka usaha maupun untuk memiliki properti di Indonesia kian besar. Mengingat Indonesia merupakan negara dengan perekonomian yang berkembang, sehingga akan membuat para pengusaha melirik Indonesia sebagai tempat untuk membuka berbagai usaha. Oleh karena terbatasnya dalam hal kepemilikkan tanah di Indonesia, banyak dari investor asing membuat perjanjian nominee untuk melakukan transaksi dalam investasi. Untuk itu diperlukan penelitian lebih lanjut mengenai keabsahan perjanjian nominee dalam kaitan kepemilikkan tanah di Indonesia. Dalam penelitian ini, pengumpulan data dilakukan dengan cara dengan menggunakan pendekatan Perundang – undangan serta menganalisa dari beberapa referensi sehingga mendapatkan suatu kesimpulan. Meskipun Perjanjian Nominee tidak terlepas dari ketentuan Pasal 1320 KUH Perdata dan Pasal 1338 KUH Perdata, menurut penulis perjanjian tersebut dianggap sebagai salah satu bentuk penyelundupan hukum dikarenakan unsur dari salah satu syarat sah nya perjanjian dalam Pasal 1320 KUH Perdata yakni unsur Suatu Sebab yang halal tidak terpenuhi sehingga Perjanjian Nominee kaitannya dalam kepemilikkan tanah di wilayah Indonesia Batal demi Hukum, dikarenakan unsur tersebut tidak terpenuhi.
