Abstract

Since the implementation of fiduciary through online system by Minister of Law and Human Right of Republic of Indonesia, the fiduciary certificate issuance become shorter rather than manual system (issuance of fiduciary certificate can be finished only one day by a notary Public) therefore by online system, time to issued the certificate fiduciary has certainty to all business people. To see effectiveness of fiduciary online and potential risk to a Notary public with the issuance of fiduciary certificate with a shorter time is needed research regarding position of Notary public as a party to input of fiduciary data and to analysis juridical how the validity of fiduciary certificate issued and print out by Notary public. In this research, the problem need to research is how about validity of fiduciary certificate by online and how the function of Notary public to issued fiduciary certificate. Data technique collection is done by using the approach of laws and regulations and also approach through direct interview technique with the Notary public to the initial process of inputting the data until issued the online fiduciary certificate . With fiduciary by online , all process is done by notary public, and no more documents verification by Fiduciary registered office, this condition is make the all people business is asking how the supervision ( in this matter is documents verification) that all this time the documents verification is done by fiduciary registered office to hand over to become Notary public, therefore to issued or not the fiduciary certificate is decision by notary public, since Minister of Law of Human Right of Republic of Indonesia issued the fiduciary certificate is based on initial inputting the data through online system by Notary public. The issued fiduciary certificate with the shorter time is certainly expected by all business people, however the business people is also expected that the fiduciary certificate issued through online system is having the same legal force against issued fiduciary certificate through manual system, thus creating legal certainty for business people. / Semenjak diterapkannya Fidusia melalui system online oleh Menteri Hukum dan Hak Asasi Manusia Republik Indonesia, penerbitan sertifikat jaminan fidusia menjadi lebih singkat dibandingkan system manual (penerbitan sertifikat jaminan fidusia dapat selesai dilakukan satu hari oleh Notaris) sehingga melalui system online ini memiliki kepastian penerbitan sertifikat jaminan fidusia bagi para pelaku bisnis. Untuk melihat efektifitas fidusia online dan resiko yang dapat terjadi kepada Notaris dengan diterbitkannya sertifikat jaminan fidusia dalam waktu yang sangat singkat diperlukan penelitian mengenai posisi notaris sebagai pihak yang menginput data jaminan fidusia serta melakukan analisis secara yuridis bagaimana fidusia online tersebut diterapkan apakah telah sesuai dengan ketentuan Undang-Undang, termasuk bagaimana keabsahan sertipikat yang diterbitkan dan dicetak olehNotaris. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan peraturan perundang-undangan dan juga pendekatan melalui teknik wawancara dengan notaris yang melakukan proses awal penginputan data sampai dengan terbitnya sertifikat jaminan fidusia online tersebut. Dengan fidusia online ini semua tahapan dilakukan oleh Pihak Notaris, tidak ada lagi verifikasi dokumen yang dilakukan oleh Kantor Pendaftaran Fidusia, kondisi ini membuat para pelaku bisnis mempertanyakan bagaimana pengawasan (dalam hal ini adalah verifikasi data jaminan fidusia) yang selama ini dilakukan oleh Kantor Pendaftaran Fidusia dialihkan kepada Notaris, sehingga dengan demikian yang menentukan terbit tidaknya sertifikat fidusia online adalah ditangan Notaris mengingat Menteri Hukum dan Hak Asasi Manusia Republik Indonesia menerbitkan sertifikat fidusia atas dasar penginputtan yang dilakukan secara online oleh Notaris. Penerbitan sertifikat fidusia yang sangat cepat ini tentu diharapkan oleh para pelaku bisnis, namun demikian para pelaku bisnis juga mengharapkan sertifikat jaminan fidusia yang diterbitkan secara online ini juga memiliki kekuatan hukum yang sama terhadap sertifikat jaminan fidusia yang dilakukan secara manual, sehingga menciptakan adanya kepastian hukum bagi para pelaku bisnis.
