Abstract

Article 1 point 1 of Law No. 2 / 2014 About the Changes on Law No. 30 / 2004 about Notary’s Function (UUJN) stated that he or she who is labled as Notary was a public figure whom has the authority to make authentically deeds and other ones as intended in this Law. This research is conducted to know if the Emeritus Notary could be requested to take the responsible upon the deed that he or she has made, and to know the duration of the responsibility he or she could take upon the deeds according to Article 65 of UUJN. This research was a juridical normative research that examining on the regulations prevailing in Indonesia. This research focused on examining the documents or literatures which was pointing on finding the theories, the opinions that have correlation and relevant with the problems on the research. Based on the result of this research, the emeritus notary could be requested to take responsibility upon his or her acts in relation to the deed. The scope of Emeritus notary’s responsibility covered the formal truth of the deed. Regarding notary’s responsibility as a public figure whom related to the formal truth, was devided into four points: civil liability, criminal responsibility, based on UUJN, and based on notary ethic code. In determining the duration of the responsibility that the Emeritus Notary should take upon the deed that he or she has made, it must be associated with the provision regarding the time limit notary can be sued in court for the injured party as a result of a breach in an authentic deed must be based on the provisions expiration. / Pasal 1 angka 1 Undang-Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris (UUJN) menyatakan bahwa yang disebut sebagai Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik dan kewenangan lainnya sebagaimana dimaksud dalam Undang-Undang ini. Penelitian ini bertujuan untuk mengetahui apakah Emeritus notaris dapat dimintakan pertanggungjawaban terhadap akta yang pernah dibuatnya, serta mengetahui sampai kapankah batas waktu pertanggungjawaban emeritus notaris terhadap setiap akta yang pernah dibuatnya ditinjau dari Pasal 65 UUJN. Penelitian ini merupakan penelitian yang bersifat yuridis normatif yaitu penelitian terhadap hukum yang berada di dalam perundang-undangan yang berlaku di Indonesia. Penelitian ini menitikberatkan pada penelitian dokumen atau kepustakaan yang intinya mencari teori-teori, pandangan yang mempunyai korelasi dan relevan dengan permasalahan yang akan diteliti. Berdasarkan hasil penelitian emeritus notaris dapat dimintakan pertanggungjawaban terhadap perbuatannya sehubungan dengan pekerjaannya dalam membuat akta tersebut. Ruang lingkup pertanggungjawaban Emeritus notaris meliputi kebenaran formil atas akta yang dibuatnya. Mengenai tanggung jawab notaris selaku pejabat umum yang berhubungan dengan kebenaran formil, dibedakan menjadi empat poin, tanggung jawab secara perdata, pidana, berdasarkan UUJN dan berdasarkan kode etik notaris. Untuk menentukan, sampai kapankah Emeritus Notaris harus bertanggungjawab terhadap akta yang pernah dibuatnya, maka harus dikaitkan dengan ketentuan mengenai batas waktu notaris dapat diperkarakan di pengadilan bagi para pihak yang dirugikan akibat pelanggaran dalam pembuatan akta otentik harus didasarkan pada ketentuan daluwarsa.
