Abstract

Fuel Oil (BBM) is the natural resources used for the benefit of the people of Republik Indonesia as mandated by the Constitution of the Republic of Indonesia Year 1945. For the downstream fuel business activity is regulated by Oil and Gas Act No. 22 of 2001, and specifically for the distribution activities are regulated by the Decision of Ministry of Energy and Mineral Resources (ESDM) No. 16 of 2011 jo No. 27 of 2012, in which such regulation regulates the rights and obligations held by the commercial license holders and their distributors. One of the rights and obligations that need to be assessed in the fuel distribution is about the responsibility for the quality of petroleum products itself, which still has not been expressly regulated by legislation. In this study, data were collected using normative juridical done by the approach of the conceptual approach, statuta approach, and case approach, so that the legal protection afforded by the law and the subject agreement is known. The agent will have protection by the minimum appointment within at least one (1) year, with the quality assurance / quality provided by PT AKR on petroleum products provided to the agency. / Bahan Bakar Minyak (BBM) merupakan kekayaan alam yang dipergunakan untuk kemakmuran rakyat sebagaimana diamanatkan oleh Undang-Undang Dasar Republik Indonesia Tahun 1945. Untuk itu kegiatan usaha hilir BBM diatur oleh Undang-Undang Nomor 22 tahun 2001 tentang Minyak dan Gas Bumi, dengan peraturan pelaksananya melalui Peraturan Menteri Energi dan Sumber Daya Mineral (ESDM) Nomor 16 tahun 2011 yang dirubah dengan Peraturan Menteri ESDM Nomor 27 tahun 2012 tentang Kegiatan Penyaluran Bahan Bakar Minyak, dimana Peraturan Menteri ESDM mengatur hak dan kewajiban yang dimiliki oleh pemegang izin usaha niaga umum BBM maupun penyalurnya. Salah satu hak dan kewajiban yang perlu dikaji dalam penyaluran BBM adalah mengenai tanggung jawab atas mutu produk BBM itu sendiri, yang masih belum tegas diatur oleh peraturan perundang-undangan. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan metode yuridis normatis yang dilakukan dengan menelaah semua undang-undang dan regulasi yang berhubungan dengan isu hukum yang sedang ditangani dalam hal ini obyek permasalahan yang menjadi pembahasan dalam penelitian ini yaitu perlindungan hukum yang diberikan oleh undang-undang terhadap PT Pelayaran Hub Maritim sebagai penyalur BBM sehingga diketahui bahwa penyalur mendapatkan jaminan penunjukan dalam masa setidaknya 1 (satu) tahun, dengan adanya jaminan kualitas/mutu yang diberikan oleh PT AKR Corporindo atas produk BBM yang diberikan kepada penyalurnya.
