Abstract
)
The duty of notary is to perform the notary public service in the field of the deed,
as well as other duties assigned to the notaries are attached as a public official
within the scope of a notary. One authority notary is to make an authentic deed as
set out in Undang-undang Nomor 2 Tahun 2014 on amendments to Undangundang Nomor 30 Tahun 2004 About Notary, namely in making the deed of
Agreement Binding of Sale and Purchase in the process sale and purchase of land
or land and building by observing the terms of the agreement according to the
Code of Civil Law. Someone who wants to make a sale and purchase of land then
it must be done in real and cash, this is based on customary law declared
applicable and not contrary to the law, if it is not done in real and cash so that
transicition of rights will not happen. In the transition process of right to do sale
and purchase set forth in writing in the form of an authentic deed made before a
competent authority which is a functionary of the Land Deed, the deed is the deed
about deed of sale and purchase. Then it needs to be studies further in the extent
to which the authority of notary about agreement binding of sale and purchase and
the authority of functionary of land deed about deed of sale and purchase.
In this research, data collection is done by using a normative juridical method, the
method through legislation and the principles of positive law by using of
secondary legal form Code of Civil Law, Undang-undang Nomor 2 Tahun 2014
on amendments to Undang-undang Nomor 30 Tahun 2004 About Notary,
Undang-undang Nomor 5 Tahun 1960 about Basic Regulation of the Agrarian,
and so forth. From these results it can be concluded that the authority of notary
about agreement binding of sale and purchase and the authority of functionary of
land deed about deed of sale and purchase. / Tugas notaris adalah menjalankan pelayanan publik (Public Service) dibidang
pembuatan akta, serta tugas lain yang dibebankan padanya yang melekat sebagai
pejabat umum dalam ruang lingkup notaris. Salah satu kewenangan notaris adalah
membuat akta otentik seperti yang tertuang dalam Undang-Undang Nomor 2
Tahun 2014 tentang Perubahan Atas Undang-undang Nomor 30 tahun 2004
Tentang Jabatan Notaris, yaitu dalam pembuatan akta perjanjian pengikatan jual
beli dalam proses jual-beli tanah atau tanah dan bangunan dengan memperhatikan
syarat-syarat perjanjian menurut Kitab Undang-undang Hukum Perdata.
Seseorang yang ingin melakukan jual-beli maka hal tersebut harus dilakukan
secara terang dan tunai, hal ini berdasarkan hukum adat yang dinyatakan berlaku
dan tidak bertentangan dengan undang-undang, jika tidak dilakukan secara terang
dan tunai maka peralihan hak tidak akan terjadi. Dalam proses peralihan hak
seseorang harus melakukan jual-beli yang dituangkan dalam bentuk tulisan berupa
akta otentik yang dibuat dihadapan pejabat yang berwenang yaitu Pejabat
Pembuat Akta Tanah, akta tersebut adalah akta jual beli. Maka perlu dikaji lebih
lanjut sejauh mana kewenangan notaris dalam pembuatan akta pengikatan
perjanjian jual beli dalam menjalakan jabatannya, dan kewenangan pejabat
pembuat akta tanah dalam pembuatan akta jual beli.
Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan metode
pendekatan yuridis normatif, yaitu pendekatan melalui perundang-undangan dan
asas-asas hukum positif dengan menggunakan bahan hukum sekunder berupa
Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 2 tahun 2014
tentang Peraturan Jabatan Notaris, Undang-UndangNomor 5 tahun 1960 tentang
Peraturan Dasar Pokok- PokokAgraria, dan lain sebagainya. Dari hasil penelitian
tersebut dapat disimpulkan bahwa kewenangan notaris dalam pembuatan akta
perjanjian pengikatan jual beli dan kewenangan pejabat pembuat akta tanah dalam
pembuatan akta jual beli.
