Abstract
Land has a very important function in human life. Therefore, the land ownership
must be protected by law and based on constitution. In order to get legal security as right
holder of land, then the land has to be registered. The formal institution to handle land
registration is land matters office and its registration activity, the role of PPAT (Pejabat
Pembuat Akta Tanah) is needed. To investigate further the role of PPAT as city land
matters office partner, then empirical juridical law research was executed to study and
examine related regulation to PPAT authority in helping Karawang city land matters
office task performance.
Supported by field research to get data which is relevant to research questions.
This research resulted in conclusion that PPAT has 3 important roles which are as a deed
maker, help to oversee the payment of taxes and as a provider of information While the
obstacles encountered to help land registration is linked to the dual ownership , the
number of land surveyors, uncompleted requirements of taxation, temporary PPAT
mistakes, no strong witness and land registration which is not known by other heirs. / Tanah mempunyai fungsi yang sangat penting dalam kehidupan manusia. Oleh
karena itu, kepemilikan atas tanah harus dilindungi oleh hukum dan bedasarkan pada
undang-undang. Untuk memperoleh kepastian hukum bagi pemegang hak atas tanah atas
haknya maka tanahnya tersebut perlu didaftarkan. Institusi yang resmi menangani
pendaftaran tanah adalah kantor pertanahan dan dalam kegiatan pendaftaran tanah
diperlukan peran serta dari PPAT (pejabat pembuat akta tanah). Untuk meneliti lebih jauh
mengenai peran PPAT sebagai mitra kantor pertanahan, maka dilakukanlah penelitian
berjenis hukum yuridis empiris yang mempelajari dan menelaah peraturan perundangundangan yang terkait dengan wewenang PPAT dalam membantu pelaksanaan tugas
kantor pertanahan di Karawang.
Di dukung penelitian di lapangan guna memperoleh gambaran dari data yang ada
kaitannya dengan permasalahan penelitian. Penelitian ini menghasilkan kesimpulan
bahwa PPAT mempunyai 3 peran penting yaitu sebagai pembuat akta, membantu
mengawasi pembayaran pajak dan sebagai penyedia informasi. Sedangkan kendala yang
dihadapi untuk membantu pendaftaran tanah adalah terkait dengan kepemilikan ganda,
jumlah juru ukur, persyaratan perpajakan yang belum lengkap, kesalahan PPAT
sementara, saksi yang tidak cukup kuat dan pendaftaran yang tidak diketahui ahli waris
lainnya.
