Abstract

Trademark law is the main tool for businesses to protect the symbols or marks that identify the origin of services and products. The twin goals of trademark law are preventing businesses from getting a free ride off the creativity of others in naming and distinguishing services and products and preventing customers from being confused by names that are misleadingly similar. Trademark law explicates assignment or transfer of ownership where holder can relocate that right to another party. According to Trademark Law of 1961 a trademark cannot be transferred without company relocation that is being run by owner of the trademark. However, adjusting to current development, such regulation cannot be up hold since the trademark and company owner may consist of different parties which are person and/or company. Transfer of rights on those trademarks must be registered and recorded in the 'Berita Resmi Negara' and binding to third parties accordingly.
