The international trade activities grows rapidly, it drives the global market into free trade. Intellectual Property Rights is part of the global market and the international trade as well. Therefore Intellectual Property Rights laws must be able to protect any right holders of IPR for the purpose of rules of law. Trade Mark is one of the International Property Rights; therefore it is also part of the international trade components itself. The efficiency of legal proceeding of trade mark case in court will contribute something to the growth of the international market. The law No. 15/2001 is the current law of trademark in Indonesia, this law is expected to bring changes in regards with trademark protection in particular the efficiency of legal proceeding in the field of settelement of trademark disputes before the court. The change is at much since the activities of international nee trade is very fast, therefore the settlement needs effectiveness, professionalism, high moral integrity, efficiency, transparency and accountability of the authorities and any involved party. The Commercial Court is the justice institution for trademark dispute settlement in Indonesia. This institution is expected to be able to procede all trademark cases settlement as efficient as it can and the verdict must also be effective and suitable the need of fairness and justice of the IPR society
