From these results it can be concluded that the receivables are still tied guarantee with Authorization For Assignment Of Mortgage doesn’t always become an obstacle in the process of issuing the EBA in order to protect the interests of investors throughout the selection process in the stages of the process is done properly and correctly. / Dalam proses penerbitan EBA pada proses sekuritisasi KPR, hak tagih yang terdapat dalam piutang KPR dan beserta dengan Hak Tanggungan yang melekat padanya dijual oleh Bank secara cessie kepada perusahaan pembiayaan sekunder perumahan. Tidak semua hak tagih tersebut berdasarkan piutang yang telah dilengkapi dengan Hak Tanggungan karena jaminan masih diikat dalam bentuk Surat Kuasa Membebankan Hak Tanggungan. Inti dari transaksi sekuritisasi adalah bahwa yang menjadi pokok ukurannnya investasi bukanlah kelayakan kredit dari Penerbit, tetapi tersedianya kumpulan piutang (portofolio tagihan) yang berkualitas baik dan memenuhi kriteria standar tertentu sehingga bersama dengan aspek-aspek lain akan menjaga performance piutang tersebut selalu dalam kondisi baik sampai piutang tersebut dilunasi. Seleksi yang ketat dan terjaganya performance piutang kaan menghindari proses eksekusi daripada hak jaminan yang akan membutuhkan biaya untuk menyempurnakan hak jaminan pada kumpulan piutang dengan pengikatan masih dalam bentuk Surat Kuasa Membebankan Hak Tanggungan Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan Undang-Undang (statute approach) dan pendekatan konseptual (conceptual approach), yaitu dengan mewawancarai langsung kepada pihak-pihak yang terlibat langsung dalam proses penerbitan EBA. Dari hasil penelitian tersebut dapat disimpulkan bahwa piutang yang masih diikat jaminannya dengan Surat Kuasa Membebankan Hak Tanggungan tidak selalu menjadi kendala dalam proses penerbitan EBA untuk melindungi kepentingan investor sepanjang proses seleksi dalam tahapan proses tersebut dilakukan dengan baik dan benar.
