Abstract

In April 1994 the Final Act Embodying the Uruguay Round cf Multilateral Trade Negotiation has been signed ir. Marakesh Conference by 125 countries/parties includir.g Indonesia. Indonesia has ratified the Agreemenz and promulgated Law No. 7 Year 1994 concernir.g the Ratification of Agreement on Establisr.ing the World Trade Organization (WTO) in ::ovember 1994. Trade Related Aspects of Intellectual Property Rights (TRIPS) as Annex 1C of the Aσreement v/as er.rry into force according to tne WTO establisr.nent. However _RIPS has been showing its controversy. This is due ~c the tight ar.d broad intellectual property right prc~ection while WTO's objectives and pαrposes are to eliminate all kind of trade barriers. Other issue is related to nhe controversial claαse of P.rticle I~.3(b) TRIPS which provision is to elaborate rhe possibility of patent on living organism. In the other hand, United Nations Convention on Biologicsl Diversity (CBD) has been signed in Rio de Janeiro in June 1992 by 157 countries/parties including Indonesia. Indonesia has ratified the CBD and promjlgated Law No. 5 Year 1994 in August 1994. CBD provisions mainly deal with the protection and sustainable use of biological diversity for present and next generation of human being. The implementation of TRIPS pertaining to the protection of biological diversity in Indonesia is specifically dealing with patent and plant variety protection. There are some significant changes in the substances of patent law from Law No. 6 Year 1989 to Law No. 13 Year 1997 and to Law No. 14 Year 2001, this latest revision has accommodated patent provision in TRIPS in order to synchronize and harmonize the patent law. With regards to the plant variety protection, Law N'o. 29 Year 2000 has been enacted as sui generis system to protect the plant variety. Lastly, rhe precautionary principle should be taken into the implementation of TRIPS in the basis of CBD and GATT. Therefore the current patent law shall be reevaluated for an amendment
