The need of money drives every person to put effort in acquiring it. As the need of money or capital is increasing, the number of institutions and legal entities dealing with the financing and intermediation business is growing also. One of the intermediation institution that has been widely accepted and become the part of society is bank. Terminology that commonly used for getting money from bank is Loan. In Loan Agreement, the borrower is called Debtor and the Lender is called Creditor. As the time pass by, there are many cases in which Debtor is unable to pay and/or to continue paying the loan back to the Creditor. There are many means to deal with the Debtor's inability to return the loan to Creditor, among others, by giving up or surrendering the pledge of collateral to Creditor, by executing the pledge of collateral and by transferring the receivables and/or loan by means of Cession, Subrogation and Novatio.
