Abstract

Regulation No. 15/2001 regarding Trade Mark was regulating and protecting the authorization of owner and right holder upon trade mark. Becoming important because it was very possible to having resemblance and similarity of marks for any goods and service. In globalization, the trade of any goods and services became extending. Today so many goods with famed brand and most people are very please to have brand because would advanced their status upon society. Plus ease way to having the goods with brand including in Indonesia but the price was more expensive. For Indonesian peoples, the alternative was looking or buying the false good with inexpensive price. Unfortunately, the false good made by Small Business who was founding by Department of Trade and Industry of Indonesia. The aim of founding program was for extend the labor opportunity but this policy also not mindful the realization of protecting the fame brand specially foreign brand. This condition was emerging the negative opinion for Indonesia regarding investment with foreign investor. They will think twice for investing their finance capital. If was very ingood situation because the effects like no labor opportunity cause no business activity based on capital investment it will reduce the state income also because no transaction. Indonesian will having loose mush as development country. Regulation No. 15/2001, chapter X V Section 90-95 was regulating the criminal sanction for trade mark violation. This law also regulate of the fame brand with 4 strategic technique
