Abstract
The attachment of mortgage is comprised of the granting of mortgage and
registration of mortgage. The granting of mortgage is proven through the
Mortgage Deed made by Land Deed Official. The registration of mortgage is
proven through the issuance of mortgage certificate.
In the present research, the main problem pertains to the position of
mortgage deed that is not followed by registration of mortgage. Further, what are
the causes of such failure of registration of security rights over land? To answer
these questions, normative and empirical legal research is conducted. Data
collection is conducted qualitatively and conclusion is drawn through logical
deductive.
Based on the analysis on a number of literatures and laws and regulations,
several conclusions can be drawn, namely that: 1) The position of Mortgage Deed
that is not followed by registration of mortgage still functions as authentic deed;
2) Land Deed Official that commits negligence is subject to penalty that is
regulated under the relevant laws and regulations. / Pembebanan hak tanggungan terdiri dari pemberian hak tanggungan dan
pendaftaran hak tanggungan. Pemberian hak tanggungan dibuktikan dengan Akta
Pemberian Hak Tanggungan yang dibuat oleh Pejabat Pembuat Akta Tanah.
Pendaftaran hak tanggungan dibuktikan dengan penerbitan sertipikat hak
tanggungan. Dalam penelitian pokok permasalahan yang timbul adalah bagaimana
kedudukan akta pemberian hak tanggungan yang tidak ditindak lanjuti dengan
pendaftaran hak tanggungan? Dan apa saja penyebab akta pemberian hak
tanggungan tidak ditindaklanjuti dengan pendafatran hak jaminan atas tanah?.
Untuk menjawab pertanyaan ini dilakukan penelitian hukum yuridis normati dan
yuridis empiris.dengan pengelolaan data secarakualitatif dan penarikan
kesimpulan secara logika deduktif
Berdasarkan analisis terhadap beberapa literatur dan peraturan perundangundangan, ditarik kesimpulan bahwa 1) Kedudukan Akta Pemberian Hak
Tanggungan yang tidak ditindaklanjuti pendaftaran hak tanggungan adalah tetap
sebagai akta otentik. 2) PPAT yang melakukan kelalaian dapat dikenakan sanksi
sebagaimana yang diatur dalam peraturan perudang-undangan.
