Abstract
The discourse of this thesis is about The Role of the Notary and/or PPAT in the
making of The Deed of Credit Agreement and the Deed of Bank Guarantee
particularly in the Imposition/Granting of the Dependent Rights. This thesis is a
normative legal research which using a descriptive approach. As a state officials
who do their tasks under oath, Notary/PPAT have an important role in every deed
that they have made. In this thesis, the writer emphasize more on The Deed of
Credit Agreement made by notary and Deed of Grant Agreement made by PPAT,
which is that deed can be used as a written proof and has a full power of law when
there are dispute between the lender and the debtor. So that the Notary/PPAT have
to be more detail as well as true in their task in order to avoid any mistake which
cause the cancelation of the deed. Also it is of course detrimental to the relevant
parties, that is the owner of mortgage dependent rights and the creditors about the
protection to the lender when the cancelation of Dependant Rights executable. / Tesis ini membahas mengenai Peranan Notaris Dan/Atau PPAT ( Pejabat
Pembuat Akta Tanah) Dalam Pembuatan Akta Perjanjian Kredit Dan Akta
Jaminan Bank Khususnya Dalam Rangka Pembebanan/Pemberian Hak
Tanggungan. Tesis ini merupakan penelitian hukum yang bersifat normatif
dengan pendekatan secara deskriptif. Sebagai pejabat negara yang melakukan
tugas-tugasnya di bawah sumpah, Notaris/PPAT tentunya memiliki peranan
penting dalam setiap akta yang dibuatnya. Dalam tesis ini penulis lebih
menekankan pada akta jaminan kredit yang dibuat oleh notaris dan Akta
Pemberian Hak Tanggungan (APHT) yang dibuat oleh PPAT, dimana akta
tersebut merupakan bukti dalam bentuk akta yang memiliki kekuatan hukum yang
sempurna ketika terjadi sengketa antara kreditur dan debitur. Oleh karena itu
dalam melaksanakan tugasnya Notaris/PPAT dituntut untuk lebih jelas dan
terinci/detail agar tidak terjadi kesalahan yang dapat mengakibatkan
dibatalkannya akta-akta yang dibuat oleh Notaris/PPAT tersebut. Hal ini yang
tentu saja merugikan pihak-pihak terkait, dalam hal ini pemilik Hak Tanggungan
dan kreditur. Juga tentang perlindungan terhadap kreditur ketika hak tanggungan
dibatalkan pengadilan yang telah berkekuatan hukum tetap.
