Abstract
Collateral in a credit agreement function as security for Banks on the debtor’s
debt. Collateral in form of land is registered under mortgage (hak tanggungan).
The case of PT. SUN vs. PT Bank Permata illustrates an example of mortgage
execution due to non-performing loans. Relevant questions thus arise on how
execution toward a portion of PT. SUN’s assets with attached security right can be
performed and the challenges thereof, and how transfer of title can be conducted
by Land Deed Officer (Pejabat Pembuat Akta Tanah) toward such executed assets
based on Indonesian Mortgage Law (UU Hak Tanggungan). The present research
is essentially a normative-explanatory research. The data used in this research is
secondary data that is analyzed through a normative-legal approach. This research
concludes that the underhand sale (penjualan di bawah tangan) agreed upon by PT
Bank Permata and PT. SUN faces a challenge since PT. SUN did not conduct
sales toward a portion of collateral as agreed. An execution by order of the Court,
as requested by the Bank, was then performed toward the collateral objects. This
is followed by a process of auction. It can be seen from the above that transfer of
title by Land Deed Officer can be conducted in two ways in accordance with the
Indonesian Mortgage Law, namely through direct sales and through public
auction by order of the State Court’s Chairman. / Objek jaminan yang diatur dalam perjanjian kredit bertujuan untuk memberikan
kepastian hukum kepada kreditur mengenai barang yang digunakan untuk
menjamin hutang debitur. Tanah sebagai objek jaminan dibebani dengan hak
tanggungan sehingga dapat dieksekusi saat terjadi kredit macet. Kasus PT. SUN
melawan PT. Bank Permata Tbk. (Bank) merupakan contoh proses eksekusi hak
tanggungan yang disebabkan karena terjadinya kredit macet. Dalam hal tersebut
timbul pertanyaan bagaimana eksekusi sebagian aset PT. SUN yang sudah
dibebani hak tanggungan beserta kendalanya dan bagaimana proses eksekusi atas
sebagian objek jaminan tersebut dapat dilakukan proses balik nama oleh Pejabat
Pembuat Akta Tanah (PPAT) sesuai dengan Undang – undang Hak tanggungan.
Penelitian ini merupakan penelitian normatif yang bersifat eksplanatoris. Data
yang digunakan dalam penelitian ini adalah data sekunder dengan melakukan
pendekatan undang – undang. Kesimpulan dari penelitian ini bahwa proses
penjualan secara di bawah tangan yang telah disepakati oleh Bank dan PT. SUN
menghadapi kendala karena PT. SUN tidak melakukan penjualan terhadap
sebagian jaminan yang telah disepakati, yang mana atas hal tersebut dilakukan sita
jaminan atas sebagian jaminan oleh pengadilan atas perminataan bank yang
dilanjutkan dengan proses lelang. Dari hal tersebut dapat dilihat bahwa objek
jaminan yang sudah dibebani hak tanggungan masih dapat dijual di bawah tangan
dengan persetujuan kedua belah pihak oleh karena itu, proses balik nama oleh
PPAT dapat dilaksanakan dengan dua cara yaitu eksekusi penjualan dibawah
tangan dan dengan cara menjual objek hak tanggungan melalui pelelangan umum
dengan perintah di bawah pimpinan ketua pengadilan negeri, yang mana kedua
hal tersebut sudah sesuai dengan ketentuan Undang – undang Hak Tanggungan.
