Abstract

Ada pepatah dalam bahasa Belanda menyatakan de betaler is koning yang secara harafiah diartikan pembeli adalah raja, artinya pemilik barang dan jasa akan berbuat yang terbaik untuk para pelanggan atau konsumennya karena dengan layanan tersebut bisnis mereka akan berkelanjutan dan lancar. Tetapi kenyataannya di Indonesia menunjukkan pembeli barang dan/atau jasa (konsumen) bukanlah raja, mereka bahkan dapat disebut sebagai korban dari sebuah budaya kekuasaan dan kapitalistik pelaku usaha yang tidak mengindahkan hak-hak konsumen. Konsumen yang tidak memiliki akses kekuasaan karena relasi, posisi atau uang praktis akan kalah dalam menuntut hak pelayanan publik, hal tersebut diperburuk dengan kebutaan konsumen akan hak-haknya maupun tindakan hukum untuk mendapat hak-hak tersebut jika haknya dilanggar. Dari sisi pelaku usaha, konsumen harus dipandang sebagai raja yang harus dihormati dan dan diberikan pelayanan yang sebaik mungkin karena konsumen adalah sumber hidup bagi pelaku usaha. Kepuasan akan layanan tersebut akan memotivasi konsumen untuk selalu memakai barang dan/atau jasa yang akhirnya berpengaruh juga terhadap kelangsungan hidup pelaku usaha. Untuk memotivasi konsumen menggunakan barang dan/atau jasa yang diproduksi oleh pelaku usaha, perlu adanya jaminan keamanan bagi konsumen dalam mengkonsumsi barang dan/atau jasa tersebut. Jaminan keamanan yaitu berupa tanggung jawab produk dan tanggung jawab profesional terhadap barang dan/atau jasa yang diproduksinya. Dalam tulisan ini membahas sampai sejauh mana pelaku usaha harus bertanggung jawab atas barang dan/atau jasa yang dihasilkannya/diproduksinya / (E) There is a Dutch aphorism said "de betaler is koning" literally interpreted that the buyer is king, its meaning that entrepreneur will do the best for their customer because with such service, the entrepreneur would have a smooth and continuity business. In the contrary, real life in Indonesia showed that the customer (consumer) would not be treated as a king, they even called as a victim of a power culture and capitalism culture of the entrepreneur whom did not appreciate the consumer right. Consumer which no access to power because of relation, position or money will Iose on their battle against public service, this condition even getting worse with the consumer blindness on their right and legal action to get those right if their right have been violated. From the entrepreneur side, the consumer should be treated as a king which deserves respect and given the best service because the consumer is the entrepreneur's Iivelihood. The consumer satisfaction on the entrepreneur service will motivate the customer to use the product, which eventually creates a great impact on the entrepreneur livelihood. In order to motivate the consumer to use the product, the consumer need guarantee from the entrepreneur that the product is safe. The safety guarantee is the entrepreneur product liability and the entrepreneur professional liability in each product and/or service they manufactured. In this thesis discuss how far the entrepreneur shall be responsible for the product and/or service they manufactured.
