Abstract
PPAT is the competent authority to make an authentic deed regarding certain
legal actions such as the transfer of rights to land, which one of it is the deed of sale.
As the competent authority, PPAT shall be responsible for the deed he made,
including a deed made under false identity. It is therefore important for PPAT to
meticulously and carefully verify the identity of the clientaccording the the provisions
laid out it the Act as a necessary condition so that the deed does not contain legal
flaws and open opportunites to committed an unlawful act that could harm others.
The purpose of this study focused to determine the responsibility of PPAT in
the event of legal defects in the Sale and Purchase Agreements that resulted in losses
to the other party due to negligence and lack of carefulness ot the PPAT in
conducting their duties. The method used in this study is normative legal research.
PPAT, who in conducting his profession, make mistakes or is negligent that
causes harm to others, could be held liable in terms of civil and administrative terms.
To that end, PPAT should make efforts to overcome the obstacles in proving the
identity of the parties, which can be proven through formal requirements before the
deed of sale and purchase is executed. / PPAT ialah pejabat yang berwenang untuk membuat akta otentik mengenai
perbuatan hukum tertentu seperti peralihan hak atas tanah, Salah satunya adalah akta
jual beli. Sebagai pejabat yang berwenang, PPAT harus bertanggung jawab atas akta
yang dibuatnya, termasuk akta yang dibuat berdasarkan identitas palsu. Oleh karena
itu penting bagi PPAT untuk bersikap cermat dan hati-hati memeriksa kebenaran
identitas para penghadap oleh Undang-Undang ditetapkan sebagai syarat penting agar
akta tersebut tidak mengandung cacat hukum dan membuka peluang melakukan
perbuatan melawan hukum yang dapat merugikan orang lain.
Tujuan penelitian ini di fokuskan pada upaya untuk mengetahui tanggung
jawab PPAT dalam hal terjadi cacat hukum dalam Akta Jual Beli yang
mengakibatkan kerugian pada pihak lain karena kelalaian dan ketidak telitian PPAT
dalam menjalankan tugasnya. Metode penelitian yang digunakan dalam penelitian ini
adalah penelitian hukum normatif.
PPAT yang dalam melaksanakan jabatanya melakukan kesalahan atau
kelalaian yang membawa kerugian pada pihak lain, dapat dikenakan tanggung jawab
dari segi perdata dan segi administrasi. Untuk itu, PPAT harus melakukan upaya
untuk mengatasi kendala dalam pembuktian identitas para pihak, diantaranya bisa
diatasi melalui pembuktian melalui syarat formal sebelum dilaksanakan akta jual beli.
