Abstract

This study to examine about result of the alternative accomplishment of the problem credit in Indonesian Banking System. This study has designed to know, that the problem credit becomes fluent credit again to create stable process in debtor business and restructuring. Beside that, this study has purpose to know that the problem credit lawsuit can be finished by or without by bankruptcy law process. This research is also has purpose to know that when creditor use the bankruptcy law process to finish the problem credit lawsuit. Research method which used in this study is normative juridical approach and analysis descriptive specification to obtain data in form primary, secondary and tertier and field research to obtain the primary data. Data analysis is performed using qualitative method. The research effort shows, that finishing to the problem credit which performed by bank (creditor) to debtor (customer or client) which their credit is categorized problem credit as follows : If it meets the restructuring requirement, so debtor (bank) party will reach the rehabilitation strategy, because basically stable or unstable of bank depend on its credit quality. If it isn't meet the restructuring requirements, so creditor (bank) party will finish the problem credit lawsuit without using bankruptcy law process, such as by arbitration law and Alternative Finishing of Lawsuit, because this process considers more economic. If both vases can't finished to the problem credit, so as long as meet requirements to make process of the bankruptcy law, so by the force action debtor (bank) party will reach this way as their responsibility to manage the third fund party (public) which believed for to them
