Fashion design work is one of the Intellectual Property Right's object of protection. Fashion design work is product of mind creation which requires legal protection, since legal problems such as copying or using or publication without permission has become a serious problem. Fashion design work is included in artistic work, in which many times overlapping among regulations which it occurs. Both legal protection on Copyright and Industrial Design Right protect artistic work in the same way/manner. Those overlapping usually occurs when a design as a work of art could also be protected by Copyright. Copyright is protected by Undang-undang Nomor 19 Tahun 2002 about Hak Cipta, while industrial design is protected by Undang-undang Nomor 31 Tahun 2000 about Desain Industri. This thesis will discuss the legal protection of fashion design work, including the problems' found on the efforts to pursue it.
