Abstract
Land functions convertion means changing of the previously approved functions
and utilizations of land, based on article 1 paragraph 10 of Government
Regulation of Municipality of Tangerang No. 11 of 2006. The issues in this thesis
are related to the changing of social and public facilities functions in Melati Mas
Residence of Tangerang City to become Fiducia Hotel and the impact and
solutions of the problems related to the land functions convertion under the
relevant laws and regulationssss. To solve the problems, the writer conducts
normative legal research to the relevant laws and regulations with data analisis by
using kualitative method. The results are (1) the land functions convertion, i.e.:
the changing of social and public facilities functions in Melati Mas Residence of
Tangerang City to become Fiducia Hotel appears because the developer, i.e.: PT
Cowell sells the land for the purposes of social and public facilities functions, the
land has been transfered to the Regional Government of Tangerang; (2) the impact
of land functions convertion is Siripada Tempel submits a clam againts the
Regional Government, several goverment officers of Tangerang Municipality.
Therefore, the parties are obliged to meet the Disctrict Atorney of Tangerang
related to these matters. The solutions are related to the obligations to pay
retributions of spatial utilization convertion to be calculated in accordance with
provision of article 16 paragraph (1) of Regional Government Regulation No. 11
of 2006 regarding Spatial Utilization Permit, the license revocation is not in line
with the provisions of article 37 paragraph 7 of Law No. 26 of 2007 regarding
spatial management and claim from Siripada Temple based on article 66 of Law
No. 26 of 2007 regarding Spatial Management. / Alih fungsi adalah perubahan fungsi pemanfaatan ruang dari fungsi yang telah
ditetapkan dalam ijin sebelumnya, Pasal 1 butir 10 Peraturan Daerah Kabupaten
Tangerang No. 11 Tahun 2006. Permasalahan dalam tesis ini adalah bagaimana
dapat terjadi pengalihan fungsi tanah fasilitas sosial dan fasilitas umum di
perumahan Melati Mas Residence Kota Tangerang Selatan menjadi Hotel Fiducia,
bagaimana dampak dan upaya penyelesaian permasalahan pengalihan fungsi tanah
fasilitas sosial dan fasilitas umum di perumahan Melati Mas Residence Kota
Tangerang Selatan menjadi Hotel Fiducia menurut peraturan perundangundangan. Untuk menjawab pertanyaan ini dilakukan penelitian hukum normatif
terhadap peraturan perundang-undangan yang mendasarinya, dengan pengolahan
data secara kualitatif. Hasil penelitan yang diperoleh adalah 1) Terjadinya
pengalihan fungsi tanah fasilitas sosial dan fasilitas umum di perumahan Melati
Mas Residence menjadi Hotel Fiducia adalah karena pihak developer (PT.
Cowell) menjual tanah fasilitas umum dan fasilitas sosial yang telah ia serahkan
kepada Pemerintah Daerah Kabupaten Tangerang 2) Dampak dari alih fungsi ini
adalah pihak Vihara Siripada merasa dirugikan sehingga mengajukan gugatan
ganti rugi kepada Pemerintah Daerah, beberapa pejabat Kabupaten Tangerang
dipanggil oleh kejaksaan Negeri Tangerang berkaitan dengan hal ini, solusinya
adalah mengenai pengenaan retribusi perubahan pemanfaatan ruang sesuai
perhitungan yang terdapat pada Pasal 16 ayat (1) Peraturan Daerah Kabupaten
Tangerang Nomor 11 Tahun 2006 tentang Izin Pemanfaatan Ruang, pembatalan
izin yang tidak sesuai dengan ketentuan sebagaimana terdapat dalam Pasal 37 ayat
(7) Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang dan
mengenai gugatan ganti rugi yang diajukan oleh pihak Vihara Siripada sesuai
dengan Pasal 66 Undang-undang Nomor 26 Tahun 2007 tentang Penataan Ruang.
