Abstract

The progressive growth of population Indonesia is not properly balanced with the increase of decent suitable housing for the population to own. Apartment ownership is the solution in the face overpopulation and the undersupply of decent housing. In accordance to the principle of nationality that are regulated in Law Number 5 of 1960 concerning The Basic Provisions of The Principles of Agrarian, only Indonesian nationals are eligible for freehold title (“hak milik”), whereas foreign nationals are only eligible for conditional land use (“hak pakai”) regulated by the agrarian act and related government regulation that support it. Regarding the ownership of an apartment, foreign nationals are only limited to hold property rights of apartment units that are built on right of use title (“hak pakai”). Property rights of apartment units that are built on non right to use title can be indirectly obtained by foreign nationals through ab intestate inheritance. In accordance to article 21 verse 3 and article 26 verse 3 of Law Number 5 of 1960, foreign nationals are therefore obliged to release said property rights within a year as a result of such regulations. Hence, the purposes of this research are first, to examine the underlying regulations of apartment ownership for foreign nationals in Indonesia and second to examine the role of Notary/Land Deed Officer in dealing with the legal ramifications of bequeathing property rights of apartment units built in non right of use title to foreign nations, moreover on how Notary/Land Deed Officer facilitate the release of property right through certain mechanism and authentic notary deeds which are made in the interest of preserving the property right as well as avoiding lawful nullification and release of property right into government hands. / Laju pertumbuhan penduduk di Indonesia tidak diimbangi dengan adanya ketersediaan lahan yang cukup bagi masyarakat untuk dapat memiliki hunian yang layak. Kepemilikan satuan rumah susun adalah solusi dari permasalahan kepadatan penduduk dan kurangnya pemukiman yang layak tersebut. Sesuai dengan prinsip nasionalitas yang dianut dalam Undang-Undang Nomor 5 Tahun 1960 tentang Ketentuan Dasar Pokok-Pokok Agraria, hanya Warga Negara Indonesia yang berhak atas hak milik, sedangkan bagi Warga Negara Asing hanya dimungkinkan memegang hak pakai. Termasuk dalam kepemilikan satuan rumah susun, Warga Negara Asing hanya berhak memiliki hak milik atas satuan rumah susun yang berdiri di atas tanah hak pakai. Perolehan hak milik atas satuan rumah susun yang berada di atas tanah bukan hak pakai dapat terjadi melalui adanya pewarisan secara ab intestato dimana Warga Negara Asing secara tidak langsung memperoleh hak tersebut. Sesuai dengan ketentuan Pasal 21 ayat 3 dan Pasal 26 ayat 3 Undang-Undang Nomor 5 Tahun 1960 tentang Ketentuan Dasar Pokok-Pokok Agraria, maka sebagai akibat hukum dari perolehan tersebut, Warga Negara Asing yang bersangkutan berkewajiban untuk melepaskan hak tersebut dalam jangka waktu 1 tahun sejak diperolehnya hak. Maka, tujuan dari penelitian ini pertama adalah untuk menganalisa bagaimana pengatuan kepemilikan satuan rumah susun bagi Warga Negara Asing di Indonesia serta kedua untuk menganalisa peran Notaris/PPAT dalam mengatasi akibat hukum dari pewarisan satuan rumah susun yang berdiri di atas tanah bukan hak pakai kepada Warga Negara Asing, lebih jauh lagi bagaimana Notaris/PPAT memfasilitasi pelepasan hak tersebut melalui mekanisme tertentu dan pembuatan akta otentik supaya hak tersebut tidak hapus karena hukum dan kembali menjadi tanah dalam hak menguasai negara.
