Abstract

Law Number 5 of 1960 concerning to Basic Regulations of Agrarian (UUPA) mentioned in Article 19 that to create the legal certainty in land aspect, government organizes land registration, which has regulated in Government Regulation. Related to the mandate from UUPA, the government has issued the Government Regulation Number 24 of 1997 concerning Land Registration, in that Government Regulation clearly mentioned about land registration procedures, including valid and powerful evidence of the land, which is certificate. Before UUPA was regulated, the evidence of land ownership could be girik, petuk, and others, but after UUPA issued, the lands with girik, petuk and others must be converted to the other rights of land as regulated in UUPA, therefore girik was no longer used as the evidence of right of land, because only certificate was valid. UUPA issued since 55 years ago, but the implication is not yet optimal, in verdict by Supreme Court number 2971 K/PDT/2010 between PT. Porta Nigra and Province Government of DKI Jakarta, they decided that girik is valid than certificate. That issue makes the Writer wanted to observe, because it is not accordance to UUPA and the Government Regulation, and how the certificate holders get the legal certainty towards the land that they owned. / Undang-Undang Nomor 5 Tahun 1960 tentang (UUPA) menyebutkan dalam Pasal 19 bahwa untuk menciptakan kepastian hukum pertanahan, pemerintah menyelenggarakan pendafitaran tanah, yang mana mengenai hal tersebut diatur dalam Peraturan Pemerintah. Berkaitan dengan amanat yang diberikan oleh UUPA tersebut , pemerintah menerbitkan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendafitaran Tanah, dalam Peraturan Pemerintah tersebut memaparkan secara jelas mengenai prosedur pendaftaran tanah, termasuk alat bukti yang sah dan kuat yang akan dimiliki oleh orang yang mendaftarkan tanah, yaitu Sertifikat. Sebelum dikeluarkannya UUPA, bukti kepemilikan hak atas tanah dapat berupa girik, petuk dan lain sebagimana, namun sejak dikeluarkannya UUPA , tanah-tanah girik, petuk dan lain sebagainya tersebut harus dikonversi dengan hak-hak atas tanah yang telah diatur dalam UUPA, sehingga girik tidak dapat digunakan sebagai alat bukti hak atas tanah lagi, karena telah berlaku sertifikat. UUPA lahir sejak 55 tahun lalu, namun masih belum diterapkan dengan maksimal, dalam Putusan Mahkamah Agung Nomor 2971 K/PDT/2010 antara PT Porta Nigra dan Pemerintah Provinsi DKI Jakarta memutuskan bahwa girik dapat mengalahkan sertifikat. Hal tersebut yang hendak diteliti oleh Peneliti tentang penyimpangan ini, dan bagaimana para pemegang sertifikat tanah tetap mendapatkan kepastian hukum atas tanah yang dimilikinya.
