Abstract
Contents:House represent primary requirement for most family, both for living in
rural and also in urban wich respresenting primary requirement. Accomplishment
of primary requirement , cannot fulfill by everybody to buy cash. Therefore,
needed an monetary institue to give fund aid in the form channeling of credit
especially in house ownership credit ( KPR ) in lending Notaries may not refuse to
make the neccessary certificates unless there are fundamental reasons. In making
the deed of sale and purchase agreement, the Notary must pay attention to rules
and norms. Notary role in the process of buying and selling them to make the deed
binding sale and purchase, publishing covernote to the Bank. Acts will be
evidence in the transition process right to purchase the object. Mistake converning
the identity of the penghadap listed in the deed, the Bank intentionally or
unintentionally, then there was a mistake or fraud, wich can cause it unlawful for
an authentic deed notary deed. / Rumah adalah kebutuhan primer bagi sebagian besar keluarga, baik yang tinggal
di pedesaan maupun perkotaan yang merupakan suatu kebutuhan primer.
Pemenuhan kebutuhan primer tersebut, tidak dapat dipenuhi oleh semua orang
untuk membeli secara tunai. Oleh karena itu, diperlukan suatu lembaga keuangan
untuk memberikan bantuan dana dala, bentuk penyaluran kredit terutama dalam
kredit pemilikan rumah ( KPR ). Penelitian ini bertujuan untuk mengetahui
bagaimana peranan Notaris dalam hal pembuatan akta yang berkaitan dengan jual
beli dengan pembiayaan Bank, dan bagaimana pengawasan Pihak Bank dalam
proses pencairan dana. Dalam perkreditan peraturan dan norma yang berlaku
Peranan Notaris dalam proses jual beli diantaranya membuat akta pengikatan jual
beli, penerbitan covernote untuk pihak Bank. Akta-akta tersebut akan menjadi alat
bukti dalam proses peralihan hak atas objek jual beli. Prihal adanya kekeliruan
identitas para penghadap yang tercantum dalam akta, Bank sengaja maupun tidak
sengaja, maka terjadilah suatu kekeliruan atau penipuan, yang dapat menimbulkan
tidak sahnya akta Notaris sebagai akta otentik.
