Abstract

With the development of a more and more rapid economy, hence emerge an criminal act named "fraudulent misrepresentation" which occurred in the field of stock market, tax and banking, tendr and advertisement as as in the statement of governmet official. "fraudulent misrepresentation" basically can be reffered to as the statement of false information to the public with the purpose of individual or group benefit. Such action is considered illegal in conducting business. Whereas advertisement can be seen as compulsory to the business to introduced and grabbing the attention of the public for his/her product. Ads is undoubtedly a compulsory as information to the customer so that they can choose the right thing for their needs. In the case, an advertisement is nor a destructive way or act if made rightly. Advertisement shall turn into a harmful act toward other if presented using misguided or even false information. Claims in advertisement recently has grown. Whereas fo now, advertisement delivering false messages or information. The stipulations on KUHP, such as article 378 of KUHP, apparently cannot or hard to be made as a groundwork for making claim on unfair business competition whereas in such cases costumers is the casualty of the battle. Even inreality, there are many infringement made by advertiser that causes loss to the costumer. For those matters, it is appropriate to employ a complete costumer protection program in the business of false advertisement . In this case, coporate crime can be dealt by implementing Law no. 8 year 1999 concerning costumer protection.
