Abstract
PPAT is public officials who are authorized to make an authentic
deed concerning specific legal deeds about land rights over unit of
flats. As authtentic deed in his deeds shall follow the laws and other
regulations. In fact, the making of the deeds is often not in
accordance with the procedures for making of the deed and this may
rise to legal issues and there is no legal certainty regarding the land
rights. One of the common is the signing of the deed of PPAT
outside the PPAT working area, it then will arise the various
implications of the law against the deed and against the officials who
make the authentic deed, whether it is in accordance with the
applicable legislation and how the protection of the parties to the
deed of sale and purchase. PPAT fully responsible over the execution
of the duties of his office and responsible to make an authentic deed.
Based on this, the author is interested and intends to examine and
understand more about the procedures for making PPAT deeds by
using normative juridicial methods, which is focuses on the research
of secondary data over the data law, i.e. written legal norms. Based
on the data obtained, the research results obtained that the legal
consequences of an act which is not in accordance with the
procedure of making the deed may result in degraded, annulled by
law or may be cancelled. / PPAT adalah pejabat umum yang berwenang untuk membuat akta otentik
mengenai perbuatan hukum tertentu mengenai hak atas tanah dan atau Hak
Milik Atas Satuan Rumah Susun. Sebagai akta otentik, akta PPAT
haruslah memenuhi aturan dan tata cara pembuatan akta PPAT
sebagaimana yang telah ditentukan oleh undang-undang dan peraturanperaturan lainnya. Dalam kenyataannya, pembuatan akta seringkali tidak
sesuai dengan tata cara pembuatan akta dan hal tersebut dapat
menimbulkan permasalahan hukum serta tidak ada kepastian hukum
mengenai hak atas tanah tersebut. Salah satu yang sering terjadi adalah
penandatanganan akta PPAT diluar wilayah kerja PPAT, dengan adanya
hal tersebut maka akan timbul berbagai implikasi hukum terhadap akta dan
terhadap pejabat yang membuat akta otentik tersebut, apakah hal tersebut
sesuai dengan peraturan perundang-undangan yang berlaku dan bagaimana
perlindungan terhadap para pihak dalam akta jual beli tersebut. PPAT
bertanggung jawab secara penuh atas pelaksanaan tugas dan jabatannya
dalam setiap pembutan akta. Berdasarkan hal ini, penulis tertarik dan
bermaksud untuk mengkaji dan memahami lebih dalam mengenai tata cara
pembuatan akta jual beli yang dilakukan oleh PPAT dengan menggunakan
metode penelitian kepustakaan yang bersifat yurudis normatif, yaitu
penelitian yang menitikberatkan pada penelitian data-data sekunder atas
data hukum, yaitu norma hukum tertulis. Berdasarkan data hasil penelitian
yang didapatkan, diperoleh bahwa akibat hukum dari pembuatan akta yang
tidak sesuai prosedur dengan tata cara pembuatan akta dapat
mengakibatkan akta tersebut terdegradasi menjadi dibawah tangan, batal
demi hukum atau dapat dibatalkan.
