Arbitration as one of the alternative dispute resolution, Indonesia has regulated in Law No. 30 year of 1999 subject Arbitration and Alternative Dispute Resolution. In principal arbitral award has final and binding enforcement, final which means cannot be confronted by several legal action such as : appeal, higher appeal and re-determination. Binding, means the arbitral award not limited for the controversy parties but also other nations that already made ratification of New York Convention 1958 about Recognition and Enforcement International or Foreign Arbitral Award. With the international arbitral award in Chevron case against Ekuador Government Country, whom forbidding the enforcement of Ekuador Provincial Court of Sucumbíos, Sole Division, because such award arise in litigation fraud, extortion, misleading of judge discretion. This matter cause the problem of Ekuador Provincial Court of Sucumbíos, Sole Division, court decision that punished Chevron to pay USD. 18.000.0000.000,-, in countries who, already ratificate New York Convention 1958. The same subject matter also in arbitration cases between Pertamina and Karaha Bodas Company (KBC), Pertamina cannot avoid the responsibility to enforce the international arbitral award to KBC in amount of USD. 261.166.654,92 with four percent of interest as per January 1st 2001, based on decision of the Supreme Court of Republic Indonesia Number. 01/BANDING/Wasit.Int/2002 on March 8 2004. The final and binding of this arbitral award is an eminence of dispute settlement using arbitration upon litigation proceedings
