Abstract

Corporate developments in Indonesia in a short time becomes very fast and very rapidly due to its expansive reach all areas of business that has the ability to thrive and be profitable. Another thing is also characterized by the role by the government through regulations that provide ease of doing business and other facilities to the corporate entity. The existence of the corporation who committed the crime today is not a rare thing, the mass media frequently reported about crimes committed by corporations both overseas and domestically. In fact, many companies / corporations or legal entities engaged in the industry does not treat industrial waste properly so that it causes environmental pollution, especially pollution of rivers, sea and land as an industrial waste disposal site. In this case there should be criminal liability expressly, that the corporation does not cause harm to the environment such as pollution of rivers, seas and beaches, or endanger the lives of workers or the public or other, also that the corporation does not become a growing proliferation of corruption. Every person has the equal right to good environment and healthy, everyone is obliged to maintain the preservation of the environment and prevent and control pollution and environmental destruction. Function of Law Environmental Management is an umbrella law regulating the environment in its provisions regulate only the basic stuff only, then before any implementing regulations, of course, will face obstacles in its application. The author picked up and tried to analyze the case of an appeal of PT. Dongwoo Environmental Indonesia engaged in waste management. PT. Dongwoo Environmental Indonesia is a Foreign Investment Company engaged in the processing of liquid Waste Hazardous and Toxic Materials, waste Hazardous and Toxic Materials result from waste disposal has led many residents are disturbed digestion, respiration and activity of citizens disturbed and contaminated soil around the location of Waste Hazardous and Toxic Materials so that groundwater can not be used citizen. This resulted in the PT. Dongwoo Environmental Indonesia sued to court and charged by Function of Law Environmental Management, until the Supreme Court. In this study the authors attempted to reveal the criminal liability of corporate environmental crime, especially on issues of Waste Hazardous and Toxic Materials. Moreover, the authors try to express the constraints faced in the enforcement of environmental law in Indonesia
