Abstract

Merek sangat penting dalam dunia perdagangan barang maupun jasa. Merek sebagai salah satu kekayaan intelektual berfungsi sebagai tanda pengenal atau daya pembeda dari merek lainnya. Kekayaan Intelektual sudah diatur dalam perundang-undangan nasional. Hak Cipta diatur dalam Undang-Undang Nomor 28 Tahun 2014; Paten diatur dalam Undang-Undang Nomor 13 Tahun 2016; Merek diatur dalam Undang-Undang Nomor 20 Tahun 2016. Dalam penelitian ini pengumpulan data dilakukan dengan pendekatan studi kasus dengan menggunakan sumber hukum primer,sekunder, tersier dan Non hukum. Hasil penelitian menunjukkan Putusan Mahkamah Agung Nomor 576 K/Pdt.Sus-HKI/2020 bahwa prinsip first to file itu sudah baik, efektif dan memadai untuk melindungi mereka yang pertama kali mendaftarkan dengan etikad baik, namun pelaksanaan aturan mengenai merek dagang terkenal, ternyata pada kasus ini tidak relevan. Hal ini bukan penolakan bahwa Ruben Samuel Onsu (BENSU) adalah orang terkenal, dan merek terkenal. Namun ia dikalahkan oleh prinsip siapa yang mendaftar terlebih dahulu pada Kementerian Hukum dan Hak Asasi Manusia. / Trademark is very essential in trade good or services. Trademark as one of intellectual property has function as badge or distinctive sign from other trademark. Intellectual property rights are regulated in National legislation. Copyright a regulated in Law no. 28 of 2014, Paten Law No. 13 of 2016; Trademark Law No. 20 of 2016.” In this research, data collection was carried out using a case study approach by using primary, secondary, tertiary and non-legal sources of law. The result of the study show that the Supreme Court decision No. 576 K/Pdt.Sus-HKI/2020 is good, effective and sufficient to protect trademark that register first with good intetion, however the implementation of the famous trademark rule turned out to be irrelevant in this case. This is not a denial that Ruben Samuel Onsu (BENSU) is a famous person and a famous brand, but he is defeated by the principle of who registers first in the Ministry of Law and Human Rights.
