Abstract
Penelitian ini bertujuan untuk menganalisa pengaturan mengenai perlindungan hukum bagi jingle sebagai merek non-tradisional suara dan pelaksanaan perlindungan hukum bagi jingle sebagai merek non-tradisional suara yang digunakan kembali sebagai karya musik. Latar belakang penulisan ini disebabkan masih kurangnya pemahaman mengenai merek non-tradisional suara dikarenakan sebelumnya segala bentuk suara termasuk jingle hanya dilindungi oleh Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Jenis penelitian ini termasuk penelitian normatif yang didukung dengan kajian empiris. Analisis dilakukan dengan pendekatan perundang-undangan. Selain itu dilakukan wawancara dengan narasumber yang dipilih. Hasil penelitian menunjukan bahwa ketentuan dalam Undang-Undang Nomor 20 Tahun 2016 masih belum memadai dalam melindungi jingle sebagai merek non-tradisional suara. Kemudian, dalam ketentuan merek hanya mengatur jingle yang digunakan dalam perdagangan barang atau jasa. Tidak terdapat aturan mengenai modifikasi terhadap jingle sebagai merek non-tradisional yang diubah menjadi suatu karya musik / This study aims to analyze the regulation regarding legal protection for jingle as a non-traditional sound mark and the implementation of legal protection for jingle as non-traditionak sound mark that is reused as music. The background of this writing is due to a lack of understanding of non-traditional sound mark because previously all forms of sound including jingle were only protected by Law of The Republic of Indonesia Number 28 of 2014 on Copyrights. This type of reseacrh includes normative research supported by empirical studies. The research uses a statutory approach. In addition, interviews are conducted with selected speakers. The result shows that the provisions in Law of The Republic of Indonesia Number 20 of 2016 there are still inadequate in protecting jingle as a non-traditional sound mark. Then, in the provisions of the mark only regulate the jingle used in the trade of goods or services. There are no rules regarding the modification of the jingle as a non-traditional sound mark that is converted into a music.
