Abstract

Through the establishment of Law No. 5/1999 regarding The Prohibition of Monopolistic Practices and Unfair Competition it is hoped that fair competition will be created, and an efficient market economy will arise. But it is understood that this law is not completely perfect and there are weaknesses, in law enforcement. It stratified from Law No. 5/1999, dispose gave special notice on case investigation by KPPU (The Supervisory Commission For Business Competition) only and some disregard the rule of other institution role in enforcement of competition law. There is no technical regulation of procedure in case investigation when court institution examine the Objection of KPPU's decision from actors. Beginning from Indomobil case (stock selling bid) in 2002, One of decision from Court First Instance is, Indonesia needs competition law of procedure in competition case investigation when court institution examine the objection of KPPU's decision from actors. The law procedure is important for business actors, KPPU (The Supervisory Commission For Business Competition)or other institutions that are related. To fullfil the empty room of law procedure, the Supreme Court finally issued Perma No. 1 Tahun 2003 (Regulation of Supreme Court No. 1 Tahun 2003) regarding The Procedure of Objection Submission of KPPU's decision. This regulation is binding for all court Fisrt Isntance at Indonesia, KPPU and business actors. The regulation explained the law position of KPPU as party and giving law power to KPPU's decision itself. Beside that, the objection of KPPU's decision from business actors should be submit to Court First Instance, also Court do the investigation and making the decision only based on KPPU's decision and documents of cases.
