Abstract

Indonesia is one of developing countries attractive to foreign investors for their capital investment. One of the motivating factors for the entry of foreign investors is the abundance of relatively cheap labor compared to that in their countries of origin. Therefore, many foreign capital investment companies with various forms of cooperation with the national capital and in various business lines are growlng and flourishing. In fact, legal protection of Indonesian workers in general and those working at foreign capital investment companies in particular seems to remain ignored. Such condition is aggravated by the remaining weak law enforcenient and deficient legal certainty in Indonesia, notwithstanding the fact that several laws and regulations on manpower have been put into effect. Not to mention that workers arc generally in a position of subordination to the management, whereby they have no strong bargaining posltion in deaiing witii tfae management. Therefore, endeavours should be immediately made to actualize legal protection for workers. One of the endeavours which can be made to actualize legal protection for workers is by means of entering into and enforcing employment agreements. Employment agreement plays an important and strategic role in initiating employment relationship since employment conditions as well as rights and obligations of both parties whieb. may determine the fate of a worker during his employment are set forth therein
