Abstract

Tesis ini membahas mengenai peran dari appraisal dan Kantor Pertanahan terhadap penentuan harga dalam pembebasan tanah yang bertujuan untuk kepentingan umum, pada dasarnya pengadaan tanah mempunyai pemahaman yang sama dengan pembebasan tanah. Peraturan-peraturan mengenai pembebasan tanah juga diatur di dalam pengadaan tanah, rumusan masalah dalam penelitian ini adalah penetapan harga untuk ganti rugi terhadap tanah yang digunakan untuk kepentingan umum dan cara penyelesaian hukum jika terjadi sengketa apabila harga untuk ganti rugi tersebut tidak sesuai dengan kesepakatan, jenis penelitian dalam tesis ini adalah normatif empiris, jenis data yang digunakan dalam penelitian ini adalah data sekunder, cara perolehan data menggunakan data sekunder melalui teknik kepustakaan, pendekatan yang digunakan dalam penelitian ini adalah pendekatan Undang-Undang dan pendekatan kasus, analisa yang digunakan dalam penulisan tesis ini adalah analisis data secara induktif, hasil penelitian dalam tesis ini adalah cara penetapan harga ganti kerugian terhadap tanah yang akan dijadikan objek pengadaan tanah dengan melihat pada nilai pasar, jika terjadi sengketa maka pemilik hak atas tanah dapat mengajukan gugatan ke pengadilan negeri dalam jangka waktu 14 hari setelah menerima penetapan harga yang telah diberikan oleh appraisal. / This thesis discusses the role of the appraisal and the land office in determining price in land acquisition for the purposes of public interest, basically land acquisition has the same understanding as land acquiatin, the regulations regarding land acquisition are also regulated in land acquisition, the formulation of the problem in this study is the determination of the price for compensation for land used for public interest and legal settlement methods in case of a dispute if the price for compensation is not in accordance with the aggrement, the research in this thesis in normative empirical, the type of data used in this research is secondary data, the way of obtaining data uses secobdary f=data techniques, the approach used in this research is the law approach and the case approach, the analysis used in thesis writing this is an inductive data analysis, the result of the research in this tesis is a method of determining the price of compensation for land which will be used as the object of land acquisition by looking at the market value, if a dispute occurs, the owner of land rights can file lawsuit to the district court a time of 14 days after receiving the price fixing that has been given by the appraisal.
