Notaris Pengganti menjalankan fungsinya sebagai Notaris, karena dialah yang memegang hak secara penuh untuk dan atas nama jabatannya tersebut selama Notaris yang digantikan melaksanakan masa cutinya. Akan tetapi dalam prakteknya atau pada kenyataanya “Das Sein”, masih ada Notaris yang dalam masa cutinya tetap melakukan tindakan hukum dalam jabatannya tersebut dengan membuat akta. Jelas tindakan tersebut tidak sejalan dengan apa yang diatur dalam Undang-Undang Jabatan Notaris. Tesis ini menggunakan tipe penelitian yuridis empiris, dan menggunakan jenis data sekunder. Hasil penelitian menunjukan bahwa Notaris Cuti yang membuat Akta pada masa cutinya diberhentikan secara tidak hormat karena melanggar ketentuan UUJN, dan Kode Etik Notaris. Dan Notaris Pengganti yang memasang papan nama Notaris yang digantikannya, khususnya melanggar ketentuan mengenai kantor Notaris wajib mempunyai hanya satu kantor, yaitu ditempat kedudukannya. / Substitute Notary performs its function as a Notary, because he is the one who has full of rights to and in the name of his office as long as the replaced Notary executes his leave. However, in practice or in fact "Das Sein", There is a Notary who still continue to take legal action in his position by making a feed durung his leave period. Obviously the action is not in same with the Laws of the Notary Department. This thesis uses a type of judicial empirical, and using secondary data types. The results showed that the notary was dishonorably discharged for violating the provisions of UUJN, and the subsitude Notary who set name board the notary he/ she subsitude for, particularly violates the provisions regarding Notary is obliged to have only one office, namely at the place of his position.
