In accordance with the Law of the Republic of Indonesia Number 21 Year 2011 concerning the Financial Services Authority as amended by Law of the Republic of Indonesia Number 4 Year 2023 concerning Development and Strengthening of the Financial Sector, Otoritas Jasa Keuangan as financial services authority has the task of carrying out the oversight function of the insurance industry and protection of consumers of financial services. In order to fulfill the tasks, Otoritas Jasa Keuangan has various powers, including appointing statutory managers. Statutory Managers will be responsible to take over the authority of the Board of Directors and/or Board of Commissioners of insurance companies that are in financial difficulties that endangers the interests of policyholders. Various cases of default by insurance companies that have occurred in Indonesia recently have eroded public confidence. Otoritas Jasa Keuangan is responsible to restore the trust. This research is a normative legal research using a comparative approach to law and legislation. The results of the study show that the provisions regarding the appointment and authority of statutory managers in the insurance industry have not provided legal certainty for policyholders. The appointment of a statutory manager in the context of rescuing a troubled insurance company should be used as the last step before revoking a business license, so an in-depth analysis is required before making a decision. This study proposes to improve the provisions of the statutory management by adding decision diagram during analysis of troubled insurance companies, enhancing the authority of the statutory managers to take over shareholder rights, and involving Lembaga Penjamin Simpanan in rescuing insurance companies in financial difficulties before the liquidation process begin. By empowering statutory managers in rescuing insurance companies with financial difficulties in Indonesia, Otoritas Jasa Keuangan will be able to play a more active role in realizing protection for Indonesian consumers of financial services.
