Abstract

Penelitian ini berkaitan dengan kasus jual beli obat dumolid dalam kasus aktor Tora Sudiro, salah satu jenis obat tergolong psikotropika yang dijual serta mudah didapatkan di beberapa apotik yaitu obat dumolid. Obat dumolid mengandung zat aktif Nitrazepam yang dapat mempengaruhi saraf pusat yang menyebabkan perubahan khas aktifitas mental dan perilaku seseorang. Penyalahgunaan obat dumolid diatur dalam Undang-Undang Nomor 5 Tahun 1997 tentang Psikotropika (selanjutnya disebut UU 5/1997). Terkait dengan permasalahan penyalahgunaan obat dumolid di Indonesia perlu diketahui pengaturan terhadap pelaku penyalahgunaan obat dumolid yang ditinjau dari hukum pidana Indonesia serta bentuk pertanggungjawaban pidana terhadap pelaku penyalahgunaan obat dumolid tersebut. Jenis penelitian yang digunakan dalam penulisan jurnal ini yaitu jenis penelitian hukum normatif, dengan melihat pada permasalahan yang ada kemudian dikaitkan dengan peraturan perundang-undangan. Hasil penelitian menunjukan bahwa sanksi pidana yang diberikan sebagai bentuk pertanggungjawaban pidana bagi pelaku penyalahgunaan obat dumolid yaitu didasarkan pada Pasal 62 UU 5/1997, yang menyatakan pelaku penyalahguna obat dumolid diberikan sanksi pidana berupa pidana penjara dan denda. Pasal 37 ayat (1) dan ayat (20) dan Pasal 41 UU 5/1997 menyatakan bahwa ketergantungan psikotropika dapat dijatuhkan sanksi rehabilitasi, sebagai alternatif menggantikan pidana penjara. Namun, apakah Tora Sudiro mempertanggung jawabkan kejahatannya seorang diri, pada titik inilah penelitian hukum ini berjalan / This research relates to the case of buying and selling of dumolid drugs in the case of actor Tora Sudiro, one type of drug that is classified as a psychotropic drug that is sold and easily found in several pharmacies, namely dumolid drug. The drug dumolid contains the active substance Nitrazepam which can affect the central nervous system causing changes typical of a person's mental activity and behavior. The abuse of dumolid drugs is regulated in Law Number 5 of 1997 concerning Psychotropics (hereinafter referred to as the Psychotropic Law). Related to the problem of dumolid drug abuse in Indonesia, it is necessary to know the regulation of dumolid drug abusers in terms of Indonesian criminal law as well as the form of criminal liability for the dumolid drug abusers. The type of research used in writing this journal is the type of normative legal research, by looking at the existing problems which are then linked to laws and regulations. The results of the study show that the criminal sanctions given as a form of criminal responsibility for dumolid drug abusers are based on Article 62 of the Psychotropic Law, which states that dumolid drug abusers are given criminal sanctions in the form of imprisonment and fines. Article 37 paragraph (1) and paragraph (20) and Article 41 of the Psychotropic Law state that psychotropic dependence can be subject to rehabilitation sanctions, as an alternative to imprisonment. However, whether Tora Sudiro is responsible for his crimes alone, it is at this point that this legal research takes place.
