The promulgation of the Minister of Trade Regulation No 77 of 2016 is being followed with a complaint from European Tyre and Rubbers Manufacturers’ Association and questions from European Union to Indonesia in World Trade Organization Forum consequently. In regards of that issue, this thesis aims to examine the consistency of the Minister of Trade Regulation No 77 of 2016 with WTO Agreement and Indonesian Domestic Laws and Regulations. Further with the result of the first examination this thesis also aims to contribute applicable recommendations for the authoritative decision makers and future studies. In doing this thesis, the method used is normative legal research with statute approach where the data collected are secondary data. The result of the analysis shows that the Minister of Trade Regulation No 77 of 2016 is inconsistent with WTO Agreement but consistent with higher ranked Indonesian Domestic Laws and Regulations. Thus, the writer suggests several recommendations in amending parts of the Minister of Trade Regulation No 77 of 2016 to avoid any dispute claim from the other WTO Members.
