Industrial design is a creative sense and skill of human beings realized in the form of a usable product or finished product. Only industrial designs that meet certain requirements legal protection. According to Article 2 paragraph (1) of the Industrial Design Law the requirement to obtain legal protection of industrial design is refering to the quality of the design that has to be novel (novelty) and has been registered. Industrial design are not protected refers to an industrial designs which are contrary to the legislation in force, public order, religion or morality. Protection of industrial design is enforceable for the limited period of 10 years prescribed by law. Disputes between PT Hitachi Construction Machinery Indonesia and PT Basuki Pratama Engineering is one of the dispute regarding the infringement of industrial design which is quite complex and cumbersome. The dispute is a challenge, especially for law enforcement agencies in implementation works effective and adequate legal protection of industrial design.
