Abstract

Trademarks that have been registered should receive legal protection. In the process of registration, the Directorate General of Intellectual Property Rights should conduct a substantive examination in order to avoid overlaping with the registration of other brands that have similarities in the essence. Application for Registration of the trademark can be given if it has been approved to meet the requirements stipulated in Law No. 15 of 2001 on Marks. Among them, must be based on good faith. The trademark registration of "Natasha Skin Care" is considered to have no good faith because it has similarities principally under the brand name of "Natasha" who was first registered. The trademark of "Natasha Skin Care" later was canceled by the Directorate General of Intellectual Property Rights on the basis of the Commercial Court Decree No. 03/HAKI/M/2009/PN.Niaga.Smg. The cancellation of this trademark will not eliminate the poor performance record of the Directorate General of Intellectual Property Rights for publishing certificates with the trademark that does not meet the criteria under Law No.15 of 2001 on trademarks. If these kind of problems do not immediately get the attention of the Indonesian government, it will influence the climate investment in Indonesia that needs the legal certainty and security for funds invested.
