In married life, every couple wants to have children to pass on the offspring, but in reality many married couples who do not obtain offspring. Therefore, couples who want children, eventually adopted the child to continue the descent. Adoption has been set in legislation, but still there are deviations in terms of adoption of children. Deviations that occur in terms of adoption of children is illegal adoption. Illegal adoption can be done in various ways, one of them by falsifying the identity of the child. By falsifying the identity of an adopted child, then it will decide the relationship between the child's birth parents. This violates the provisions of child protection laws. Illegal adoption made by certain parties to gain advantage. Illegal adoption occurred because of a lack of research / observation time of making the documents concerning the child to be adopted. Lack of education about adoption also affects the growth of illegal adoption in the community. It takes a rule that can be adopted in more detail, both the procedures and sanctions for perpetrators of illegal adoption. This study discusses the procedures for adoption, the rights of adopted children and penalties for the offenders of illegal adoption. Legal research methods used are kind of normative legal research, because this study examines and analyzes the legal issues associated with the provisions of applicable law. Legal materials used are of primary legal materials, legal materials and secondary non-legal materials. The approach used in this study is statute approach and case approach.
