There are many problems in the investment law, one of these problems is about the right of the land in the investment law. The problem is about how long the right of the land that the government can give to the investor. Because the concern of the investor is time if they invest in Indonesia with time limit that the government give for the project. This case raise up two questions, the first is how about the right of the land in the investment law and secondly is how about the rights to the building (Sertifikat Hak Guna Bangunan) in the Indonesian Constitution. This minithesis explain the definition of the rights of the buildings, the invesment, the local invesment and the foreign investment. The method used in this research is the normative law research using legislative approach and case approach. And also this research use the primary law materials, secondary law materials and non-legal materials. This minithesis talk about the investment law in Indonesian and also the rights of the building in connection to investment law, and talk deeply the decision from the Constitutional Court about the investment law. The conclusion about the rights of the land in the investment law is it can be the rights of the building, and with the decision from the Constitutional Court, in investment law is amended on the chapter about the rights of the land.
