Abstract

Bankruptcy or insolvency is a familiar term in Indonesia. Moreover, since the Monetary Crisis which devastated Indonesia's economy up to the rising value of dollar exchange rate against the United States Dollar. IMF (International Monetary Fund) as a Foreign Financial Institution is precisely as a pioneer for Indonesian Governments to renew the law on Bankruptcy as an absolute requirement if the Government wants to be given a new capital to mend Indonesia's economy situation. The law of bankruptcy is a law that will keep inherent in scope of business law, where between entrepreneurs will often become the borrower (debitor) or as the lenders (creditors) for the continuity of the business they do. Therefore, the importance of a law on bankruptcy is needed in a country as one of the essential factor that supports the continuity of the economy within the country. Act no. 37 of 2004 on bankruptcy and the suspension of debt repayment requires the existence of proof i.e the existence of simple debt that has been maturing and can be billed, should also be two or more creditors. The limitation to what can still be said to be simply themselves still have different point of view among the judges that cause legal uncertainty with respect to the filling of a petition in bankruptcy. Thus, the message that the author who analyzes cases in bankruptcy is giving us here so that the reader would be able to have a clear and concrete picture against restrictions on simple absolute in the terms law of bankruptcy.
