The high standard of prosecution in Indonesia against a crime of mistreatment or abusive in nature, especially the act of abusing that is done by an assembly, make the writer interested in analyzing this particular case. In this case the defendant I, II, and III have a family tied to the victims I and II. Judge's rulling No. 497/PID.B/2011/PN.TNG states that each defendant was sentenced to six months probation sentence under Article 351 paragraph (1) jo Article 55 paragraph (1) KUHP. The author in this regard is reluctant to agree with the judge's decision, in which the judge should've been able examine in more detail the role of each individual defendants in light of Article 49 of the KUHP in wich it states reasons for forgiving. The judge in this case should've been able to assessed in greater depth the facts that occurred in the trial with the present of testimonials from the witnesses in order to provide judgment that is appropriate and in correlation with law that apply to each defendant.
