Land is an essential natural resource in human life. To acquire a land can be done by the acquisition from the government and also the purchase agreement. Practically, there are frequent dual ownership over land. Disputes that occur often associated with the good faith principal. Therefore, the authors are interested in analyzing the rightsholders position of the released land with the good faith buyer, as well as the legal consequences of the purchase land agreement. The type of research used in this study is a normative legal research. This study uses Statute Approach and Case Approach. Through statute approach, researcher will try to find the ratio legis and ontological basis of legislation relating to the agreement. Jurisprudence has a special characteristic that is normative. Hence, the character of the analysis of this study was the analysis is qualitative. From the analysis conducted by the researcher, according to the researcher the rightsholders of liberated land possess preferred position compared with a good faith buyer. With the known limits of good faith, then it can be determined whether it is a valid agreement, can be canceled, and/or null and void.
