Children represent those who will advance the hopes of the nation struggle and have a strategic role, special characteristics and unique position in ensuring the continued existence of the nation and the state in the future, and therefore children's rights must be protected by government, community and family. According to Komisi Nasional Perlindungan Anak, there are 1.826 violance cases against children and Badan Pusat Statistik recorded that house become highest place of violence against children. This research aims to analyze the protection for children from domestic violence based on Child Protection Act, Law No. 23 of 2004 and Elimination of Domestic Violance Act, Law No. 23 of 2004. Beside that, the author also want to analyze the existence of Child Welfare Act, Law No. 4 of 1979 after the release of Children Protection Act, Law No. 23 of 2002. The type of research is normative legal research using library materials such as legislation, court decisions, books, legal journals, legal articles and internet media Approaches that use in this research are the statute approach and case approach. Based on the research, there are conclusions that the Child Protection Act provides more comprehensive than the Elimination of Domestic Violence Act and the existence of Children Welfare Act has been replaced by the Child Protection Act.
