Abstract
Didalam suatu proses konstruksi umumnya banyak terjadi kesalahan yang disebabkan karena faktor kesalahan manusia. Oleh karena itu, pada proyek konstruksi yang sudah selesai dibangun, diperlukan jaminan bahwa kualitasnya akan tetap terjaga walaupun telah digunakan. Masa jaminan tersebut disebut sebagai masa pemeliharaan. Tetapi selama masa pemeliharaan sering terjadi masalah-masalah yang dapat merugikan pihak-pihak yang bersangkutan.
Pengumpulan data dilakukan dengan wawancara dengan banyak praktisi yang sudah berpengalaman dengan penelitian ini. Setiap contoh kasus diberikan ulasan dan bila relevan didukung dengan standar kontrak terkait seperti FIDIC 2006, Undang-Undang Jasa Konstruksi No 18, serta Peraturan Pemerintah No 29 Tahun 2000. Kemudian diusulkan tindakan preventif bagi pihak kontraktor dan pihak pemilik agar masalah tersebut tidak terjadi kembali di masa yang akan datang. Lalu dilakukan analisis untuk mengetahui penyebab dominan permasalahan pada masa pemeliharaan.
Dari hasil penelitian, didapat bahwa permasalahan pada masa pemeliharaan dapat merugikan pihak-pihak yang bersangkutan. Bangunan permukiman merupakan jenis bangunan yang paling banyak mengalami permasalahan pada masa pemeliharaan. Pihak kontraktor selalu berusaha keras mengatasi permasalahan pada masa pemeliharaan, karena permasalahan tersebut dapat menyebabkan kemunduran pembayaran biaya retensi yang akan jauh lebih merugikan pihak kontraktor./ The construction process generally have a lot of errors that occur because of factors due to human error. Thus, on construction projects that already completed, needed assurance that the quality will still be protected even if already in use. That assurance period is referred to maintenance period. But during the maintenance period, many problems happen that can disadvantage the parts concerned.
Collecting data is done with interviews with many practitioners who have experience with this research. Each case example is given the reviews and if relevant it supported by contracts standards such as FIDIC 2006, Undang-Undang Jasa Konstruksi No 18 , and Peraturan Pemerintah No 29 Tahun 2000. After that the preventive actions are proposed for the contractor and the owner so that the problems do not occur again in the future. Then the analysis is done for the cause of the dominant problem issues during the maintenance period.
From the results of the research, the problems during the maintenance period can disadvantage the parts concerned. Residential building is a type of building that have most problems during the maintenance period. The contractor always strive to fix the problems during the maintenance period, because that problems can cause a slowdown retention payments and will disadvantage the contractor even more.
