Abstract

Myanmar merupakan salah satu negara di Asia Tenggara yang banyak menarik perhatian negara-negara di dunia terkait dengan pelanggaran hak asasi manusia yang berkepanjangan dan sisitem pemerintahan yang dipimpin oleh militer. Dua kasus pelanggaran HAM di Myanmar yang menarik banyak perhatian dan keprihatinan dari masyarakat internasional adalah kasus diskriminasi terhadap etnis minoritas Rohingya dan peristiwa Revolusi Saffron. Peran ASEAN terhadap kedua kasus ini sangat menarik untuk dibahas karena kedua kasus ini memiliki latar belakang yang berbeda dalam konteks pelanggaran HAM, namun peran pemerintah Junta Militer di kedua kasus tersebut sangat menonjol. Sebagai salah satu negara anggota ASEAN, segala hal yang terjadi di dalam negeri Myanmar dapat mempengaruhi stabilitas kawasan Asia Tenggara dan citra ASEAN dimata dunia. oleh sebab itu ASEAN berkewajiban untuk mengambil peran dalam proses penyelesaian isu pelanggaran HAM di Myanmar. Metode yang digunakan dalam penelitian ini adalah metode kualitatif dengan penyajian data secara deskriptif. Pengumpulan data dilakukan dengan menggunakan teknik studi kepustakaan dan wawancara mendalam dengan Kepala Sub-Direktorat Hukum dan HAM, Kerjasama Politik-Keamanan ASEAN. Teori dan konsep yang digunakan dalam menganalisa peran ASEAN pada kedua kasus dalam penelitian ini adalah teori liberalisme, organisasi internasional, regionalisme, hak asasi manusia, human security, dan prinsip non-interference. Dari hasil penelitian dapat disimpulkan bahwa ASEAN telah berupaya untuk mendorong demokrasi dan penegakan HAM di Myanmar. Namun peran ASEAN tersebut masih terbatas pada pernyataan dan teguran terhadap Myanmar yang sifatnya tidak dapat memaksa Myanmar untuk menyelesaikan pelanggaran HAM di negara tersebut. Peran ASEAN dalam proses penyelesaian kedua kasus ini sangat terbatas karena seringkali terbentur dengan prinsip fundamental ASEAN yaitu non-intervensi dan konsensus / Myanmar is a country located in Southeast Asia that has attracted attention from many countries in the world due to its prolonged human rights violations acts and its military-led government. Two cases of these human rights violations in Myanmar that attracted a lot of attention and concern from the international community are the discrimination cases against the Rohingya ethnic minority and the Saffron revolution. The role of ASEAN in both cases are interesting to discuss since both have different background despite still within the context of human right violations, but the roles of the military are dominant. As a member of ASEAN, everything that happens in Myanmar could affect the stability in Southeast Asia region and hurting the ASEAN’s good image in the world. Therefore, ASEAN is responsible to take part in settling the human rights violations issues in Myanmar. The method used for this study is qualitative, while the presentation of the data is descriptive narrative. The data collection is done through literature reviews and in-depth interview with the Head of Sub-Directorate of law and Human Rights, the ASEAN Political-Security Cooperation. Theories and concepts that used in analyzing the role of ASEAN in both cases in this study are the theory of liberalism, international organizations, regionalism, human rights, human security, and the principal of non-interference. From this study one can conclude that ASEAN are doing efforts to promote democracy and human rights in Myanmar. However, the role of ASEAN is still limited only to releasing statements and caution against Myanmar while it could not force Myanmar to resolve human rights violations in their country. The role of ASEAN is limited due to the organization fundamental principle of nonintervention, and consensus.
