Abstract

This thesis discuss the position of pension workers towards bankrupt companies. The motive of studying this case is to comprehend the legal protection of workers' pension rights in Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations and analyze the implementation process of submitting resistance to the Distribution List related to workers' pension rights in the Case of the Supreme Court Decision No. 824 K/Pdt. Sus-Bankruptcy/2017. The research method used is normative research. In this case, PT Hotel Panghegar went bankrupt because of its inability to pay its debts. Furthermore, PT Hotel Panghegar did not guarantee employee pension rights which are included in the preferred creditors' rights regulated in the constitution.
