The land is often transferred by legal subjects, one of which is through buying and selling. However, land trading might be carried out against the law because it was sold by people with no right to sell the land. Illegal trading will have legal consequences for the parties, and a settlement of the land sale and purchase disputes against the law should be present, as happened in the case of the Supreme Court Decision Number 1349 K/PDT/2014. The author raised two problem formulations discussed in this reaserch, i.e., how the legal consequences of the unlawful transfer of land right and how to resolve th unlawful transfer of land rights. This reaserch aimed to discover and analyze the legal consequences of the unlawful transfer of land rights and to understand and analyze the settlement of the unlawful transfer of land rights in the Supreme Court Decision Number 1349 K/PDT/2014. The research used by the author was a normative legal study using statute and case approaches. Unlawful transfer of land rights will have legal consequences for the real landowner, unauthorized sellers, buyers, and notaries who help carry out the sale and purchase. The unlawful transfer of land rights was resolved through three court levels: the Pematang Siantar District Court, the Medan High Court, and the Supreme Court.
